There is a lot of non compliance in the market; employers who don’t have plan documents or distribute SPDs, don’t know the 5500 filing requirements or have discriminatory plan designs. HIPAA Privacy and Security training is rarely provided to small groups who have access to PHI and health care reform is imposing new rules that affect many plans. Knowing what holes to look for in an employer’s compliance can help brokers attract business from groups who are out of compliance as well as protect their clients form potential fines.
